Distance Selling Contract

1. SELLER:

2. BUYER:
   Under this contract, the BUYER www.hillda.com.tr is the person who places an order through the website. The address and contact information used by the BUYER when submitting the pre-order application will be taken as a basis.

1. The subject of this contract is the BUYER's www.hillda.com.tr is to determine the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and the Regulation on the Principles and Procedures of Application of Distance Contracts, regarding the sale and delivery of products with stated selling prices that meet the qualifications mentioned in the contract, for which a pre-order has been placed electronically through the website.
2. The BUYER acknowledges and declares, in accordance with the provisions of this contract, that they are informed about all preliminary information regarding the products subject to sale, including the basic characteristics, selling price, payment method, delivery conditions, etc., and the right of withdrawal, that they have confirmed this preliminary information electronically, and that they have subsequently placed an order for the product.
3. www.hillda.com.tr The preliminary information and invoice on the site are integral parts of this contract.
4. The BUYER declares that they have read and are informed about all preliminary information regarding the basic characteristics, selling price, payment method, and delivery of the product or products specified in the contract, and that they have provided the necessary confirmation electronically.
5. This contract becomes valid after the BUYER provides the necessary electronic confirmation regarding the order of the product.

The product that the BUYER has requested to be delivered will be delivered to the address specified by the BUYER through the cargo company representative.

1. Delivery costs belong to the BUYER. Even in the case where the BUYER is not at their address at the time of delivery, the SELLER will be deemed to have fully and completely fulfilled their obligation.
2. If the product subject to the contract is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible for the refusal of delivery by the person/organization to whom delivery is to be made. Therefore, any damage arising from the BUYER's late receipt of the product and expenses arising from the product waiting at the cargo company and/or the cargo being returned to the seller are also the BUYER's responsibility.
3. Delivery is made after the stock is available and the product price has been transferred to the SELLER's account. The SELLER delivers the product within 5 days from the pre-order.
4. If the SELLER cannot deliver the product subject to the contract within the specified period due to stock shortages and similar commercial impossibilities, unexpected events, force majeure, or extraordinary situations such as adverse weather conditions preventing transportation or disruption of transportation, the SELLER is obliged to notify the BUYER. In this case, the BUYER may exercise one of the following rights: cancellation of the order, replacement of the product subject to the contract with an equivalent if available, and/or postponement of the delivery period until the obstacle is removed. If the BUYER cancels the order, the paid amount will be refunded within 1-10 business days.
5. If the product price is not paid for any reason or is cancelled in bank records, the SELLER shall be deemed to be released from the obligation to deliver the product.

1. The BUYER must inspect the product subject to the contract before taking delivery and must not accept damaged or defective products such as broken, dented, or torn packaging from the cargo company. The received product will be considered undamaged and intact. After delivery, the obligation to carefully protect the product belongs to the BUYER.
2. Furthermore, the BUYER accepts that delivery made to the address provided and to the person present at that address at the time of delivery will be considered as delivery made to the BUYER.
3. If the right of withdrawal is to be exercised, the product must not be used and must be returned together with the invoice. If the original invoice is not sent, VAT and any other legal obligations cannot be refunded to the BUYER.

1. The SELLER is responsible for delivering the product subject to the contract intact, complete, in accordance with the specifications stated in the order, and with warranty documents and user manuals if applicable. If the product subject to the contract is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible for the refusal of delivery by the person/organization to whom delivery is to be made.
2. The SELLER acknowledges that the BUYER has the right to withdraw from the contract by rejecting the product within 7 days from the date of receiving the product or signing the contract, without assuming any legal or criminal liability and without stating any reason.
3. The SELLER will refund the product price and any valuable documents within 10 days of receiving the withdrawal notice. The product will be taken back within 20 days.
4. The SELLER may, with justified reasons, supply the BUYER with a product of equal quality and price before the performance period in the contract expires. If the SELLER believes that the delivery of the product has become impossible, the SELLER must notify the BUYER before the performance period of the contract expires. In this case, the BUYER may exercise one of the following rights: cancellation of the order, replacement of the product subject to the contract with an equivalent if available, and/or postponement of the delivery period until the obstacle is removed. If the BUYER cancels the order, the paid amount and any documents will be refunded within 10 days.

1. The type and kind of the product, quantity, brand/model, color, and selling price including all taxes www.hillda.com.tr as stated in the information on the product promotion page of the website and in the invoice, which is considered an integral part of this contract.
2. The SELLER is not responsible for price update errors caused by technical reasons.
3. The cash price of the product is included in the invoice.
4. The price of the product based on the installment term applied to the selling price is included in the invoice.
5. When the BUYER makes purchases by credit card and in installments, for purchases with more than 6 installments, the selling price is determined by applying a monthly 3% interest charge. The BUYER may make some changes to the interest charge and number of installments by negotiating with their bank.
6. The down payment amount for the product is included in the invoice.

1. Since deferred sales are only made with bank credit cards, the BUYER accepts, declares, and undertakes that they will separately confirm the relevant interest rates and information regarding default interest from their bank, and that the provisions regarding interest and default interest will apply under the credit card agreement between the Bank and the BUYER in accordance with current legislation.
2. In installment transactions, the relevant provisions of the contract signed between the BUYER and the card-issuing bank apply. The credit card payment date is determined by the provisions of the contract between the bank and the BUYER. The BUYER can also track the number of installments and payments from the account statement sent by the bank.

2. Return requests are not accepted in cases where labels attached by the importer or manufacturer on the product's box have been torn, vacuum or gel packaging has been opened, or resalability features have been lost. The BUYER is obliged to return the product in the same condition as it was delivered.

4. Within 10 days following the receipt of the withdrawal notice, the product price will be refunded to the BUYER, and the product will be taken back within 20 days. If the original invoice is not sent, VAT and any other legal obligations cannot be refunded to the BUYER.
5. If the product to be returned is defective, the shipping fee will be covered by the SELLER.

Istanbul Courts and Enforcement Offices are authorized in disputes that may arise from this contract.

When payment for an order placed through the site is completed, the BUYER will be deemed to have accepted all terms and conditions of this contract. The SELLER is obliged to make the necessary software arrangements to ensure that orders cannot be placed without the BUYER's confirmation that this contract has been read and accepted on the site.
